These Terms of Use (“Terms”) govern your access to and use of yumposi.com, Yumposi restaurant guides, and related webpages and services collectively referred to as the “Service.”
By accessing or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
About Yumposi
Yumposi provides informational restaurant guides that help users explore possible menu choices and modifications associated with dietary preferences or restrictions.
Yumposi is an information service. It is not a restaurant, food-preparation service, healthcare provider, dietitian, allergen-testing service, or food-safety certification organization.
Eligibility
You may use the Service only if you can legally agree to these Terms. If you are under the age of majority where you live, you may use the Service only with the involvement and permission of a parent or legal guardian.
The Service is not directed to children under 13.
Guide Information
Restaurant guides describe modification possibilities and general dietary information. They do not guarantee that an item is safe, free of an ingredient, free from cross-contact, medically appropriate, or prepared in a particular manner.
Menus, recipes, ingredients, suppliers, equipment, staffing, and preparation practices may change without notice. You must communicate your dietary needs directly to the restaurant and confirm current information before ordering.
Your use of restaurant guides is also governed by the separate Guide Disclaimer, which is incorporated into these Terms by reference.
No Medical Advice
The Service does not provide medical, nutritional, allergy-management, or other professional healthcare advice.
Information on the Service should not replace advice from a physician, registered dietitian, allergist, or other qualified professional familiar with your individual circumstances.
Restaurant Relationships
Restaurants featured on the Service are independently owned or operated unless expressly stated otherwise. Yumposi does not control or supervise a restaurant’s food, employees, kitchens, equipment, ingredients, preparation procedures, or representations.
A restaurant’s inclusion in Yumposi does not necessarily mean that the restaurant sponsors, endorses, or has independently certified all information appearing in a guide.
Yumposi’s verification colors or labels describe the source or review status of guide information. They are not food-safety certifications or guarantees.
Permitted Use
Yumposi grants you a limited, personal, nonexclusive, nontransferable, and revocable right to access and use the Service for lawful, noncommercial purposes.
You may not:
- Copy, republish, sell, license, or commercially exploit substantial portions of the Service without written permission;
- Scrape, harvest, extract, or systematically collect guide information through automated means without written permission;
- Interfere with the operation or security of the Service;
- Attempt to gain unauthorized access to any system or information;
- Introduce malware or harmful code;
- Misrepresent your identity or relationship with Yumposi or a restaurant;
- Use the Service to violate a law or another person’s rights; or
- Use Yumposi content in a misleading manner or remove associated disclaimers.
Intellectual Property
The Service—including its original text, organization, guide format, design, graphics, logos, branding, compilations, and other original material—is owned by Yumposi or used with permission and is protected by applicable intellectual-property laws.
Restaurant names, logos, menus, and trademarks belong to their respective owners. Reference to a restaurant does not transfer ownership of its intellectual property to Yumposi and does not necessarily imply endorsement.
No right or license is granted except the limited right to use the Service described in these Terms.
Information You Submit
If you send Yumposi feedback, guide corrections, menu information, photographs, documents, or other material, you represent that you have the right to provide it.
You grant Yumposi a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, organize, and display that material as reasonably necessary to operate, correct, improve, and promote the Service.
This license does not transfer ownership of your material to Yumposi. Please do not submit confidential information or material that you are not authorized to share.
Yumposi may review, decline, remove, or correct submitted information at its discretion.
Third-Party Services and Links
The Service may include links to restaurants and other third-party websites or services. Yumposi does not control and is not responsible for third-party content, availability, security, products, services, or privacy practices.
Accessing a third-party resource is at your discretion and may be subject to separate terms and policies.
Disclaimer of Warranties
To the fullest extent permitted by law, the Service is provided on an “as is” and “as available” basis.
Yumposi does not warrant that the Service will always be available, secure, complete, accurate, current, error-free, or suitable for a particular purpose. Yumposi does not warrant the accuracy of information received from restaurants, public sources, contributors, or other third parties.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by law, Yumposi and its owners, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to use of the Service.
This includes, without limitation, damages or losses associated with reliance on guide information, restaurant conduct, ingredients, substitutions, food preparation, cross-contact, allergic reactions, illness, personal injury, unavailable menu items, interrupted website access, or third-party services.
Nothing in these Terms limits liability that cannot lawfully be limited or excluded.
Service Changes
Yumposi may add, modify, correct, suspend, or discontinue any part of the Service at any time. We may also restrict access when reasonably necessary for maintenance, security, legal compliance, or protection of the Service.
Privacy
Our collection and use of personal information is described in the Privacy Policy. By using the Service, you acknowledge that you have had an opportunity to review that policy.
Changes to These Terms
We may update these Terms as Yumposi develops. Updated Terms will be posted on this page with a revised effective date.
Your continued use of the Service after revised Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Any dispute relating to these Terms or the Service shall be brought in a court with proper jurisdiction located in Santa Barbara County, California, unless applicable law requires otherwise.
Before filing a claim, you and Yumposi agree to make a reasonable, good-faith effort to resolve the dispute informally by written communication.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. An unenforceable provision will be modified only to the minimum extent necessary to make it enforceable, when permitted by law.
No Waiver
A failure by Yumposi to enforce a provision of these Terms does not waive the right to enforce that provision later.
Entire Agreement
These Terms, together with the Privacy Policy and Guide Disclaimer, constitute the agreement between you and Yumposi concerning use of the Service.
